Regulations for online payment services via VISA and Mastercard

These regulations define the rules for providing online payment services via VISA and Mastercard within transactions processed by EPS Poland Sp. z o.o. (hereinafter referred to as the "Seller"). The regulations apply in connection with the acceptance of a commercial offer sent via e-mail by the Client.

§ 1. Transaction and Payment Process

The Seller sends the Client a commercial offer for the purchase of plywood via electronic means (e-mail). After the Client accepts the offer, the Seller issues an invoice along with an individual link for online payment. Payments via VISA, Visa Electron, Mastercard, Mastercard Electronic, or Maestro are processed through the imoje payment gateway, operated by ING Bank Śląski S.A., with its registered office at ul. Sokolska 34, 40-086 Katowice, Tax ID (NIP): 634-013-54-75 (hereinafter referred to as the "Payment Operator"). ING Bank Śląski S.A. operates under the supervision of the Polish Financial Supervision Authority (KNF) and provides payment services within the meaning of the Act of August 19, 2011, on payment services. Once the payment is credited (usually within 1 business day), the Seller fulfills the delivery of goods in accordance with the terms of the presented offer (delivery time, transport costs).

§ 2. Available Forms of Payment

  • Payment cards: VISA, Visa Electron, Mastercard, Mastercard Electronic, Maestro.
  • No additional fees are charged for the selected form of payment (in accordance with Art. 97 sec. 1 of the Act on Competition and Consumer Protection).
  • Payment is made exclusively via a link sent by e-mail along with the invoice. Card data is entered solely on the secure imoje payment page and is not stored or processed by EPS Poland Sp. z o.o. The rules for making card payments via imoje are further regulated by the imoje Payment Regulations, available at: https://data.imoje.pl/docs/imoje_regulamin_platnosci.pdf.

§ 3. Returns and Payment Complaints

  • In the event of a refund, the amount is returned to the card used for the original transaction within 14 days of the complaint being accepted or the withdrawal from the contract.
  • The right to withdraw from the contract without giving a reason within 14 days applies exclusively to natural persons making a purchase for purposes unrelated to their professional or business activity (consumers), in accordance with the Act of May 30, 2014, on consumer rights. For entrepreneurs (B2B transactions), the right of withdrawal does not apply, particularly regarding goods prepared according to individual Client specifications (e.g., plywood cut or assembled according to offer terms).
  • Complaint procedure: The Client submits a refund request via e-mail to biuro@epspoland.pl, stating the invoice number and payment reference number. The Seller verifies the request and initiates the refund through the Payment Operator imoje (ING Bank Śląski S.A.). Refund processing time: up to 3 business days from positive verification of the request. Complaints regarding payments are resolved within 14 days. Complaints regarding the payment process itself may also be submitted directly to imoje in accordance with the imoje Payment Regulations.

§ 4. Personal Data Protection

The Client provides their data voluntarily. Client data (name, surname, e-mail address, delivery address) are processed solely for the purpose of fulfilling the offer, issuing the invoice, and processing the payment, based on the Client's consent (GDPR). The data controller is EPS Poland Sp. z o.o., ul. Jabłoniowa 20/510, 80-175 Gdańsk. Data is not transferred to third parties, except for the Payment Operator (ING Bank Śląski S.A. / imoje) to the extent necessary to process the transaction. The Client has the right to access, rectify, and erase their data. The Client has the right to lodge a complaint regarding the processing of personal data with the supervisory authority (President of the Personal Data Protection Office).

§ 5. Data Deletion and Retention Period

Your personal data will be deleted once the purpose of its processing ceases. However, it may be stored longer if required by generally applicable national or EU laws (e.g., tax and accounting regulations). Data processed in connection with the conclusion and performance of a contract is stored for the duration of the contract and, after its termination, for the period necessary for the expiration of potential claims and tax obligations. Data processed based on your consent will be stored until the consent is withdrawn. After these retention periods, the data will be permanently deleted.

§ 6. Profiling and Automated Decision-Making

The result of profiling is a better alignment of marketing communication to your interests, which limits the display of irrelevant content. Important: profiling carried out by the Controller does not produce any legal effects concerning you or similarly significantly affect your situation. We do not use automated decision-making that could, for example, automatically refuse to conclude a contract or change product prices in a discriminatory manner. Every Client has the right to object to profiling by contacting us at biuro@epspoland.pl.

§ 7. Final Provisions

These regulations enter into force upon the Client's acceptance of the offer. Changes to the regulations do not apply to transactions already concluded. For matters not regulated by these regulations, the provisions of the Polish Civil Code and the Act on Consumer Rights shall apply (the 14-day right of withdrawal applies exclusively to consumers, excluding goods made to individual order).
